Current Rezoning Request

April 2025 - Presentation to HOA Board

• Stratus Properties presented Tract 110 development plans to the Circle C HOA Board of Directors and residents outlining a plan to build a mixed use, multifamily development on Tract 110 instead of office space. The plans include 1,000 apartments. 

• Materials indicate the Dahlgreen access prohibition would remain in place and Dahlgreen would be used as an emergency access only.

Summer / Fall 2025 

• Case C14-2025-0064 initiated.

• Stratus seeks a modification of the Conditional Overlay governing Tract 110 in order to build 1,000 apartments instead of offices.

• Stratus is informed by the City that a second ingress/egress point is required from the Tract 110.

December 2025 - HOA Board sends Stratus Support Letter to City

• The HOA Board provides a letter of support for Stratus' rezoning request for the modified Conditional Overlay, and the removal of the prohibition against vehicular access to Dahlgreen from Tract 110. The result will be that the segment of Dahlgreen adjacent to Kiker Elementary School and the school zone will be open to traffic generated from 1,000 apartments. 

January 2026 - Dahlgreen Amendment Added

• The application was amended to include a request to remove the prohibition on vehicular access to Dahlgreen Avenue.

March 24, 2026 

• Stratus Board of Directors unanimously approves a plan of complete liquidation and dissolution. William H. Armstrong III, Chairman of the Board and Chief Executive Officer of Stratus, said, “I am pleased that the Board, in coordination with our external advisors, has reached a decision that positions us to deliver the greatest value for stockholders and more certainty than the alternatives we considered through this rigorous process. Our liquidation and dissolution strategy assumes that the Company’s significant cash position, which will be augmented as assets are sold, will be distributed to stockholders in a tax-efficient manner, and as soon as prudent. Fully stabilized assets are expected to be sold in the near term, and our remaining high-quality, longer-duration development opportunities are expected to be methodically sold as soon as important value-enhancing entitlement and related milestones are achieved. Additionally, our plan includes significant reduction in overhead costs during the liquidation process.”

May 2026

• The hearing before the City of Austin Zoning and Platting Commission was held on May 5, 2026. Circle C residents attended and provided public comment. The proposal was reviewed by the Zoning and Platting Commission (ZAP), which resulted in a recommendation for approval by the Austin City Council. June 2026 

• The Protect Circle C Coalition met with District 8 City Council Member Paige Ellis, her staff and key department staff from City of Austin that are involved in this zoning matter. Paige Ellis affirmed her support of a postponement.  

• Stratus Town Hall was held at the Circle C Community Center on June 18th.

• June 21st - Because of your voices, we gained the support of Council Member Paige Ellis's office in securing a postponement of the upcoming vote. It has been rescheduled to September 10th. Thank you to everyone who wrote, forwarded, and encouraged others to participate.

• June 22nd - A workshop, or informal meeting, was held with the HOA Board at the request of the Protect Circle C Coalition and attended by two CCHOA Board members. The goal was to discuss Board support and finding potential solutions to the traffic and safety issues that will be generated by the Tract 110 development.

July 2026 

• Austin City Council was expected to consider the proposal on July 23, 2026. A request for postponement has been granted and it is expected that the City Council will hear this case on September 10th. 

• July 14, 2026 - Per the City’s request, Stratus filed an amendment to its zoning application increasing the zoned area (67.138 acres) to include a Dahlgreen driveway (.294 acres). This increases the zoned area to 67.432 and changes the zoning plat and the configuration of the 500' notification and 200' protest petition boundaries. A new ZAP hearing will likely be scheduled. • July 29, 2026 - The Board votes to withdraw restrictive covenant amendment made earlier this year and to communicate this to Stratus, the City and ZAP. The restrictive covenant amendment is what Stratus sought in its zoning request in order to open up Dahlgreen as an access point to the through traffic for 1,000 apartments from Tract 110.

• July 31, 2026 - That same restrictive covenant amendment was electronically recorded with Travis County Real Property Records (Instrument No. 2026091422). The filing of the amendment was not authorized by the Board, and came two days after  the Board voted to withdraw it. The Board has confirmed it did not authorize or initiate the filing. The Protect Circle C Coalition followed up with the Travis County Clerk to determine who initiated the filing. The Clerk could not identify who filed it — only that it filed electronically through Simplifile. 

August 2026

• At the August 14, 2026 Special Meeting, the Circle C Board voted to move forward with a set of agreements that many residents believe fall short of protecting the neighborhood from the real threat: a full vehicular connection between Tract 110 and Dahlgreen Avenue. While the board terminated the improperly-filed First Amendment, it simultaneously approved a Second Amendment that many residents feel effectively accepts — rather than fights — the prospect of Dahlgreen access.

• August 18, 2026 - The hearing before the City of Austin Zoning and Platting Commission was held. Circle C residents and Board member Phil Gorman attended and provided public comment. Board member Tom Griebel attended.  The Zoning and Platting Commission (ZAP) voted in favor of a recommendation for approval by the Austin City Council. September 2026

• September 10, 2026 - Austin City Council vote postponed to September 24, 2026.

• September 24, 2026 - Austin City Council votes in favor of the Stratus  (1) Tract 110 zoning application permitting up to 1,000 multifamily apartments, and access to Dahlgreen Avenue from the Tract 110 , and (2) the 4th Amendment to the 2002 Development Agreement between Stratus and the City of Austin providing Stratus the Development Density allocations needed to build 1,000 apartments, and relieving Stratus of its obligation to extend South Bay to MoPac to route traffic from Tract 110.
